Judge Lucy Koh has ordered on Monday denying the motion that Samsung has filled to lift the ban on the Galaxy Tab 10.1.
The judge has listed the reasons fro the ruling in 5 pages. First, both Apple and Samsung have agreed that the ruling by the jury did not resolve all remedies for the parties, so the ruling is not final, as far as the appealing process goes.
And since the appeal is in progress the judge has no longer authority to lift the ban unless the Federal Circuit returns the case back to her courtroom.
The ban was filed because the court found that Samsung has infringed Apple’s D889 patent, even though the jury did not come to the same decision.
The judge has cancelled the hearing scheduled for tomorrow (September 20th) and instead a post trial hearing is taking place in December to discuss Apple’s request for additional damages and injunctive relief.
